WELLalarmâ„¢ Privacy Policy

WELLalarm™ (also referred to herein as "we") understands how important the privacy of personal information is to our users.  This is the privacy policy for the WELLalarm™  web site (the Site) and will tell you what information we collect about you, as well as an explanation of the choices you have about how your personal information is used and how we protect that information. We urge you to read this privacy policy carefully.

Health care professionals and consumers alike have become increasingly aware of the need for privacy and security of a person's personal health information.  Although WELLalarm™ is not a covered entity under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), HIPAA is the federal law pursuant to which health care professionals and other covered entities must  protect patient privacy and must also provide certain notices and have certain safeguards in place to ensure the security of individually identifiable information.  As noted above, WELLalarm™ is not a covered entity as that term is defined in HIPAA and WELLalarm™ is not subject to its requirements, but WELLalarm™ recognizes and supports the spirit of the privacy laws and, where possible, WELLalarm™ s policies are in line with such spirit.  However, WELLalarm™ has designed its services to include transmission of information at times to include the use of cellular and mobile telephones and the use of SMS, the uses of which do not comply with HIPAA.

This privacy policy applies to the WELLalarm™  websites owned and operated by WELLalarm™, including WELLalarm.com, WELLalarm.mobi, mywellid.com, and my wellid.com Sites.  WELLalarm™ may share information among its subsidiaries or Sites that it owns or controls, but all such information continues to be protected under this privacy policy. 

The WELLalarm™ Site may contain links to other Sites. Once you enter another Web Site (whether through an advertisement, service, or content link), be aware that WELLalarm™ is not responsible for the privacy practices of the other Site. We encourage you to look for and review the privacy statements of each and every Web Site that you visit through a link or advertisement on WELLalarm™.


1. What Personal Information We Collect and How We Use It

There are two types of personal information that WELLalarm™ may collect:  information from which you could be individually identified (" Personal Information") and information related to your health or the health of one of your dependents ("Personal Health Information").  Both types are discussed, as applicable, throughout this policy. 

While you may use some of the functionality of WELLalarm™ without registration, many of the specific tools and services on our Site require registration.  If you use our Site without registering, the only information we collect will be non-personal information and such information will be deleted at the end of a session. 

If you register with our Site, the registration process requires the submission by you of Personal Information.  For example, if you are registering for our services or purchase a tag or other product, we will request certain Personal Information from you which may include your name, address, e-mail address or telephone number, as well as financial information to facilitate our provision of services and process payments.  Any financial information we collect is used only to bill you for the products and services you purchased.  If you purchase by credit card, this information may be forwarded to your credit card provider.

You may be asked to disclose Personal Information to us so that we can provide assistance and information to you.  For example, we may collect Personal Information from you (such as an e-mail address, system information and problem descriptions) in order to provide online technical support and troubleshooting.

At registration and at various times as you use the Site, you will be given the option of receiving recurring informational/promotional newsletters via email from WELLalarm™ and/or directly from third parties. These emails will not contain Personal Health Information.

When you visit our Site, we may track information to administer the Site and analyze its usage. Examples of information we may track include:

  • your Internet Protocol (IP) address;
  • the type of browser or computer you use, including information about your screen resolution, operating system, and whether or not your computer is Java enabled;
  • the referring Web site;
  • the city, state and/or country from which you accessed the Site;
  • the date and time of your visit;
  • the length of your visit;
  • the name of your Internet service provider;
  • the pages you viewed on the site; and 
  • Any action you take within the Service, including but not limited to all steps you take through the course of a session

Depending on the services and/or products you purchase, we may also collect your Personal Health Information.  It is first of all important for you to know that you are solely responsible for making certain the Personal Information and, critically, the Personal Health Information you submit is accurate and current.  Inaccurate information could obviously negatively affect your health or that of a dependent, as applicable.  WELLalarm™ is not responsible for the results of inaccurate information.  It is imperative to you to ensure ALL information you provide to WELLalarm™ is completely accurate and up-to-date.  It is equally imperative that you take the time to review and update ALL Personal Information and Personal Health Information on a periodic basis or when there is any change or modification to such information.

WELLalarm™ will do what you, through your purchase and use of its services and/or products, instruct it to do with Personal Health Information.  For example, if there is an emergency and you have previously provided WELLalarm™ with instructions to release your Personal Health Information to a Mr. Tom Smith, then WELLalarm™ will release the information to Mr. Smith as so instructed. In addition, for certain pre-designated Personal Health Information, such information may be made available to a person who is a bystander or first responder in an emergency situation in which you are involved. 

WELLalarm™ will also use your Personal Information and/or Personal Health Information internally (without disclosing to third parties) in the following ways:

  • as required to operate, and maintain the integrity of the Site, such as in the course of conducting maintenance of servers and related hardware;
  • in conducting investigations of fraud, criminal activity, a breach of our Terms of Use, or any other abusive or suspicious behavior; 
  • in analyzing trends to improve the service and develop other products and services;
  • To facilitate your own use of the service, which may include the initiation of email, text and voice reminders to yourself as you instruct.

In the Site, you can register to receive information on an automated, "alert" basis. The type of information that you can register to receive on an automated basis includes general information about WELLalarm™, such as:

  • Press releases;
  • News and presentations;
  • WELLinformed Newsletter
  • If you opt in to advertising emails, then such emails

The Personal Information collected when you register to receive information on an automated basis is your email address.  Each time you receive an automated email alert, you have the option of canceling your registration and removing your email from the database by simply clicking on the unsubscribe link at the bottom of each email alert message.  For medication text and alerts, automated notifications can be cancelled via the Wellcalendar feature of the service.

WELLalarm does not currently permit advertising on WELLalarm.com.  Ads may be included in WELLalarm newsletters, emails and text alerts and will be clearly designated as advertisments.

Please note, if you choose to post a message or comment to the blog or in the Facebook Group, such post will be able to be viewed by the public and will not in any way be private.  As such, you must not reveal anything personal information or information that you do not want to be public. 


2. How WELLalarm™ Handles Privacy and Security Internally
Here are some of the security procedures that WELLalarm™ uses to protect your privacy: 

  • Requires both a personal username (log-in name) and a password in order for users to access their account;
  • Uses firewalls to protect information held in our servers;
  • Utilizes Secure Socket Layer (SSL) encryption in transmitting Personal Information and Personal Health Information to our servers. In order to take advantage of encryption technology, you must have an Internet browser which supports 128-bit encryption;
  • Closely monitors the limited number of WELLalarm™  employees who have potential access to your Personal Information and/or Personal Health Information;
  • Requires all WELLalarm™  employees to abide by our privacy policy and to be subject to disciplinary action if they violate it;
  • Backs-up our systems to protect the integrity of your Personal Information and Personal Health Information;
  • Limits access to Personal Information and Personal Health Information to authorized users.  

You have full control over who has access to your Personal Health Information.  Only the person who creates a record can grant access to other users.  When you cancel an account, WELLalarm™ attempts to delete all information as soon as possible.   

Despite WELLalarm's™ efforts to protect your Personal Information and Personal Health Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

Upon your request, we will delete your Personal Information and/or Personal Health Information from our active databases and, where reasonably feasible, from our back-up media. You should be aware that it is not technologically possible to remove each and every record of the information you have provided to WELLalarm™ from our servers.

lease note that in 2005 California enacted the “Shine the Light” law (California Civil Code Section 1798.83) that permits customers of WELLalarm™ , Inc. who are California residents to request certain information regarding its disclosure (if any) of personal information during the past year to third parties for their direct marketing purposes.
